J. Joseph Bainton has practiced law for over 45 years predominantly in federal courts in close to, if not a majority of these United States in cases ranging in subject matter from trademarks/copyrights/ product liability/ professional/director-officer liability/bankruptcy adversary proceedings involving claims of fraudulent transfer and alter ego liability and simple breach of contract actions. He has served as lead counsel in cases that have resulted in well over 100 reported decisions, again predominantly in federal reporters. He has argued before the United States Supreme Court and the New York Court of Appeals, as well as the 1st, 2nd, 3rd, 5th, 7th, 8th, 9th, 11th and Federal Circuit Courts of Appeal.
Joe has tried to verdict or court decision well over 100 cases and has observed that a client's right to trial is too frequently frustrated by the combination of "electronic discovery" and people's tendency to communicate via electronic means with the result that both sides to a bona fide dispute collapse under the weight of their respective attorneys' fees. Joe brings to the table 45 years of practical experience in knowing what is ultimately important and what is not.
Depending on the nature of the case, Joe is available either as a consultant to clients uneasy about their representation by major law firms or, individually, as a trial lawyer. Today, discovery is no longer conducted by young associates with 3x5 index cards reviewing boxes of dusty documents in warehouses, but rather by highly specialized technology firms using optical scanning, combined with the "right" key words, to whittle millions of documents down to the few that matter at trial that are shown to triers of fact through the use of technology that rivals anything Hollywood has to offer. "Staging" that trial while playing a major role in its conduct is what Joe offers to potential clients.
